It is our policy to expeditiously respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (DMCA). This page describes the process to respond to a claim that content that you provided to us infringes the rights of someone else. If you believe the someone else is infringing on your content, please refer to our article "Rights Challenge - Notice of Infringement."
As with all legal matters, it is always best to consult with an attorney about your specific situation. Filmhub encourages you to do so before taking any action that might impact your rights. This article is not legal advice and should not be taken as such.
You can respond to a rights challenge in the following ways:

Do nothing, in which case we will transfer the Title to the correct rights holder; or

Agree to transfer the infringing Title to the correct rights holder; or
-
Contest the rights challenge by filing a Counter Notification.
You may respond to an Allegation of Infringement here. Your response is called a "Counter Notice." Please note:
The DMCA requires you to swear to your Counter Notice under penalty of perjury. It is a federal crime to intentionally lie in a sworn declaration. Submitting false information could also result in civil liability (a lawsuit for damages).
Submitting a DMCA Counter Notice can have real legal consequences. The person who filed the Allegation of Infringement may file a lawsuit against you. Make sure that you have thoroughly investigated the Allegation of Infringement and talked to a lawyer before submitting your Counter Notice.
You need to have a good faith belief to support your Counter Notice. Whether or not you tell us the basis for that good faith belief is up to you, in consultation with your lawyer.
Your Counter Notice must be complete. It is a legal statement that you are providing both to Filmhub and to the person who made the Allegation of Infringement. Part of that legal statement is your consent to service of a lawsuit if one is filed by the person who made the Allegation of Infringement.
Keep in mind that upon receipt of your Counter Notice, we will promptly provide the person who provided the original infringement notification with a copy of your Counter Notice. Do not include any private information or information that you do not want them to receive.
Filmhub does not have discretion. All we do is confirm whether or not the Allegation of Infringement and Counter Notice meet the minimum requirements of the DMCA.
